ያለ ዕድሜ ጋብቻን የሚፈቅድ የሕግ ረቂቅ ተዘጋጅቶ ለሶማሊያ ምክር ቤት ቀርቧል። ረቂቁ ለዘጠኝ አመት አዳጊ ጭምር ትዳር የሚፈቅድ ነው። ይኸ የሕግ ረቂቅ ለረዥም አመታት በሴቶች ላይ የሚፈጸም በደል፣ አስገድዶ መድፈር እና ያለ ዕድሜ ጋብቻ በሕግ የሚያስቀጣ እንዲሆን ሲሟገቱ ለቆዩ ማሕበራት ተቀባይነት ያለው አይደለም።

ከሶማሊያ ልጃገረዶች አንድ ሶስተኛው 18 አመት ሳይሞላቸው ይዳራሉ። አብዛኞቹ ሶስት ጉልቻ የሚመሰርቱት ገና የአስራ ሁለት/12 እና የአስራ ሦስት/13 አመት አዳጊ ሳሉ ነው። እስካሁን ድረስ ያለ ዕድሜ ጋብቻን የመለከተ ሕግ በአገሪቱ የለም። አሁን ግን ያለ ዕድሜ ጋብቻን የሚፈቅድ የሕግ ረቂቅ ተዘጋጅቶ ለአገሪቱ ምክር ቤት ቀርቧል። አዲሱ የሕግ ረቂቅ የዘጠኝ አመት ልጅን ጭምር ትዳር ይፈቅዳል። ይኸንን የሕግ ረቂቅ ከሚደግፉት መካከል የሞቃዲሾው ጠበቃ አብዲራሕማን ሐሳን ኦማር አንዱ ናቸው።

"የዘጠኝ አመት ልጅ ስትዳር ሰውነቷ ለግብረ ሥጋ ግንኙነት ዝግጁ መሆኑ ይረጋገጣል። ገና ልጅ ከሆነች ለወሲብ ዝግጁ የሚያደርጋትን ሖርሞን በሰውነቷ ታዳብራለች። ሐይማኖታችን ሴት ልጅ ለአቅመ ሔዋን ስትደርስ ትዳር እንድትመሰርት ይፈቅዳል። ይኸ እስኪሆን ድረስ ግን መጠበቅ ያስፈልጋል" ይላሉ ጠበቃው።

የእስልምና እምነት ተከታዮች በብዛት በሚኖሩባቸው ሌሎች አገሮች በቅዱስ ቁርዓን ሕግጋት መሠረት ሴት ልጅ መቼ ትዳር ትመስርት የሚል ክርክር አለ። ለሞቃዲሾው ጠበቃ ግን አንድ ነገር ግልጽ ነው። ዋናው እና አንገብጋቢው ጉዳይ አንዲት ሴት በርካታ ልጆች መውለድ ይኖርባታል። "አገሮች የተለያዩ ናቸው። ባንዳንድ አገሮች አንድ ልጅ አስራ አምስት/15 አመት ሲሞላው ወይም ሲሞላት ለአቅመ አዳም ደርሷል ወይም ለአቅመ ሔዋን ደርሳለች ይባላል። በአውሮፓ አገሮች ደግሞ አስራ ስምንት/18 አመት በሌሎች አገሮች ሃያ አንድ/21 አመት ሊሞላቸው ይገባል። ቋሚ የሆነ ዕድሜ የለም። እያንዳንዱ አገር በባሕሉ እና በሐይማኖቱ መሠረት ለራሱ መወሰን ይኖርበታል" ሲሉ አብዲራሕማን ሐሳን ኦማር ይሞግሉ።

ጠበቃ አብዲራሕማን ሐሳን ኦማር የሚደግፉት የሕግ ረቂቅ በሶማሊያ የሴቶች ማሕበራት የበረታ ተቃውሞ ገጥሞታል። ማሕበራቱ ለረዥም አመታት በሴቶች ላይ የሚፈጸም በደል፣ አስገድዶ መድፈር እና ያለ ዕድሜ ጋብቻ በሕግ የሚያስቀጣ እንዲሆን ሲሟገቱ ቆይተዋል። ይሁንና የሴቶች ማሕበራት የሚፈልጉት የሕግ ረቂቅ በሶማሊያ ምክር ቤት እንኳ ውይይት አልተደረገበትም። ይኸ ደግሞ የሴቶች መብት ተሟጋች ለሆነችው ዱንዮ መሐመድ አሊ የሚያንገበግብ ሆኖባታል።

"ይሕ የሕግ ረቂቅ ሥራ ላይ እንዲውል ብዙ ታግለናል። ይሁንና ምክር ቤቱ ጥረታችንን ችላ ብሎ ወደ ቅርጫት ጣለው። የሕግ ረቂቁ በሴቶች ላይ የሚፈጸም በደል ምንድነው የሚለውን ይበይናል። አስገድዶ መድፈርን እና ያለ ዕድሜ ጋብቻን የሚመለከት ነበር። አጥፊዎች ከባድ ቅጣት እንዲጣልባቸው ያደርጋል" ትላለች ዱንዮ።

ዱንዮ የጠቀሰችው የሕግ ረቂቅ በሶማሊያ የተባበሩት መንግሥታት ድርጅት ጽህፈት ቤት ጭምር የሚደገፍ ነበር። ይሁንና ሴቶቹ ጥረታቸው አልሰመረም። ዱንዮ እንደምታስበው ይኸ ለምን እንደሆነ ታውቃለች።

"በረቂቅ ሕጉ ላይ ድምጽ የሚሰጡ ነገር ግን ራሳቸው አዳጊዎች ማግባት የሚፈልጉ የምክር ቤት አባላት እንዳሉ እናውቃለን። ወጣት ልጃገረዶች ያገቡ በርካታ የምክር ቤት አባላትን ስም መዘርዘር እችላለሁ። ቤተሰቦቻቸው ደሐ በመሆናቸው ልጆቻቸውን ለምክር ቤት አባላቱ ይሰጧቸዋል" ትላለች።

ሶማሊያ ከዓለም ደሐ አገሮች አንዷ ናት። ከሕዝቧ አብዛኛው የሚበላው በቂ ምግብ የለውም። አገሪቱን የሰላሳ/30 አመታት የርስ በርስ ጦርነት አውድሟታል። በርካቶች አገራቸውን ጥለው ይሸሻሉ። በተለይ ለሴቶች እና አዳጊ ልጃገረዶች ነገሩ ሁሉ ተስፋ አስቆራጭ ነው።

ሳድያ ቤተሰቦቿ ደሐ ናቸው። የአስራ ሦስት/13 አመቷ አዳጊ በሞቃዲሾ በሚገኝ ትምህርት ቤት ትምህርቷን በመከታተል ላይ ትገኛለች። አዳጊዋ ቤተሰቦቿ ሊድሯት እንደሚችሉ ሥጋት አላት። "ቤተሰቦቼ እንዳይረግሙኝ ውሳኔያቸውን መስማት አለብኝ። እኔን ከዳሩኝ በሚያገኙት ገንዘብ ደስተኛ ይሆናሉ። ባልየው ደግሞ ገንዘብ ስለከፈለ እንዲያሻው ሊያደርገኝ መብት እንዳለው ያስባል። ይኸ ድብደባን ይጨምራል" ስትል የ13 አመቷ አዳጊ ታስረዳለች።

ትምህርቷን ስታጠናቅቅ ሳድያ ፖለቲከኛ የመሆን ሕልም አላት። ከዚያ ምን አልባት አንድ ቀን ታገባ ይሆናል። "የምወደውን ሰው ማግባት እፈልጋለሁ። ይኸ የሚሆነው ግን ስለ ሕይወቴ እንድወስን ነፃነት ከተሰጠኝ ብቻ ነው" ስትል ለዶይቼ ቬለ ተናግራለች።

According to the ministry, provisions that guarantee children freedom of religion, privacy, and protection from early marriage were seen as interfering with parental responsibility and Islamic values.

The announcement, made around the International Day of the Girl Child, has triggered fury online, with many accusing Somali authorities of legitimizing child abuse under the guise of religion.
